Knowledge and understanding
After successfully completing the course, students will be able to:
- explain main legal institutes in the area of legal regulation of migrations, position of foreigners and provision of asylum protection
- define the basic Croatian legislative framework that regulates the status of persons who do not have Croatian citizenship and are within the territory of the Republic of Croatia, with special emphasis on Croatian rules that regulate this problem area;
- identify rule and norm that need to be applied in individual cases depending on the status of foreign person;
- describe basic political migrations.
Application
After successfully completing the course, students will be able to:
- manage domestic legal sources related to the status of foreign persons;
- apply knowledge about norms to concrete situations that can occur in practice;
- use international legal framework that regulates the area of migrations, status of foreign persons and asylum seekers;
- demonstrate resons for denying asylum to foreign persons.
Analysis
After successfully completing the course, students will be able to:
- compare international rules that regulate the position of foreign persons with Croatian legislation, examine their adjustment and recognise possible shortcomings in the Croatian legislation;
- distinguish among different types of foreign persons depending on their legal status (foreigners citizens of EGP member states, citizens of 'third' countries, apatrids, asylum seekers, persons under subsidiary protection)
analyse how migration policy affects the perception of the position of foreign persons in Croatian public;
- verify the legitimacy and correctness of procedures of competent bodies in the implementation of migration policies and the legislative framework
Synthesis
After successfully completing the course, students will be able to:
- generalise the influence of the international legal framework on domestic legislation and practice
- propose a change of domestic norms in case of observed weaknesses of individual legislative solutions
- anticipate the consequences of changes in migration policies
- formulate the consequences of violations of the international legal framework
Evaluation
After successfully completing the course, students will be able to:
- evaluate the manner of application of relevant law to a certain case;
- estimate the future development of legal regulation of the area of the status of foreign persons under the influence of acquis communitaire
