Description |

During the course, students analyze specific normative texts (Constitution, statutes, decrees, ordinances), identify different types of legal norms and determine the hierarchical rank of norms with regard to different types of hierarchical relationships between them (formal, material, logical/linguistic and value hierarchy). Furthermore, based on the analysis of specific normative texts, students determine the content of particular legal rights (especially constitutional and real rights) and, using Hohfeld's analytical scheme, break them down into basic subjective legal positions (privilege, claim-right, immunity, power). Students analyze the practice of the Constitutional Court of the Republic of Croatia and Croatian courts and assess the degree of constitutionalization of the Croatian legal system with regard to various aspects of constitutionalisation (binding force of the constitution, adaptive interpretation of statutes, overinterpretation of constitution, direct application of constitutional norms). Students use concrete examples to identify cases of conflicts between norms and legal gaps and propose solutions to these conflicts and ways to avoid, create and fill gaps. Also, students determine the so-called frame of the norm (Kelsen) by applying generally accepted techniques of interpretation in Croatian legal practice, language rules and doctrinal theses, and justify the choice of a particular meaning and practice attributing a new ("out-of-frame") meaning to the text. Finally, by applying the analytical criteria of specialization of functions and independence of organs to relevant constitutional norms, students will judge the degree of specialization and independence of legislative, judicial and executive organs in the Republic of Croatia. |
